DECISION AND ORDER ON MOTION

Motion for permission to proceed as a poor person and to have the appeal heard on original file of the Workers' Compensation Board.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied, without costs, and without prejudice to renewal upon a showing that a timely appeal has been taken to this Court from the Board decision filed August 20, 2013. It is noted that, on renewal, claimant must also set forth sufficient facts so that the merit of the contentions underlying the appeal can be ascertained, as required by CPLR 1101 (a).
