By Order to Show Cause served May 9, 2023, the Court directed petitioner to show cause in writing why the Court should not issue an order directing that the small tax case designation be removed in this case and that the proceedings not be conducted as a small tax case. On June 27, 2023, petitioner filed a Response.

Upon due consideration of the foregoing, it is

ORDERED that, on or before September 14, 2023, respondent shall file a reply to petitioner's Response to Order to Show Cause.
