Plaintiff-appellant having moved for an enlargement of time to perfect the appeal from the order of the Supreme Court, Bronx County, entered on or about August 10, 2017, And defendant Terence Cardinal Cooke Health Care Center having appealed from an order, same Court and Justice, entered on or about November 3, 2017,Now, upon reading and filing the papers with respect to the motion, including the correspondence from counsel for defendant-appellant dated May 16, 2018, and due deliberation having been had thereon, It is ordered that plaintiff's motion is granted to the extent of enlarging the time to perfect its appeal to the December 2018 Term. The appeal brought by Terence Cardinal Cooke Health Care Center is deemed withdrawn in accordance with the aforesaid correspondence.
