Petitioner having moved for an order granting reargument and renewal of the judgment of the Supreme Court, New York County, entered on or about September 7, 2016, and vacatur of the aforesaid judgment which denied his petition for a writ of habeas corpus, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied without prejudice to a timely filed notice of appeal.
