Appeal, No. 438, Jan. T., 1970, from decree of Court of Common Pleas, Trial Division, of Philadelphia, Sept. T., 1966, No. 4257, in case of Clara B. Thomas v. Priscilla Thomas, alias Priscilla Robinson and Clarence A. Dockens. Decree vacated.

Equity. Before DOTY, J.

Adjudication filed dismissing plaintiff's complaint; exceptions thereto by plaintiff dismissed, and final decree entered. Plaintiff appealed.

Decree vacated for the reasons noted in Righter v. Righter, 442 Pa. 428, 275 A.2d 4 (1971), announced this same date. Each party to pay own costs. The matter is transferred to the Orphans' Court Division of the Court of Common Pleas of Philadelphia.

Mr. Justice COHEN took no part in the decision of this case.
