Supreme Court of Louisiana
Jan 7, 1977
340 So. 2d 990 (La. 1977)

Opinion

No. 58857.

January 7, 1977.

IN RE: WILLIAM H. STEWART, M.D. APPLYING FOR CERTIORARI, OR WRIT OF REVIEW, TO THE COURT OF APPEAL, FOURTH CIRCUIT, PARISH OF ORLEANS.

Writ denied. Under the facts found, we cannot say the result is incorrect.

SANDERS, C. J., is of the opinion that a writ should be granted, being of the opinion that the dissenting views expressed by Presiding Judge Samuel in the Court of Appeal are legally correct. See La.App., 337 So.2d 645, 647.

SUMMERS, J., is of the opinion that the writ should be granted, agreeing with the dissenting opinion of Judge Samuel. See 337 So.2d 645, 647 (La.App. 1976).
