Opinion

No. SC06-1478.

February 25, 2008.

Lower Tribunal No(s). 4D05-1341.

Upon review of the response to this Court's order to show cause dated November 14, 2007, the Court has determined that it should decline to accept jurisdiction in this case. See Brooks v. State, 32 Fla. L. Weekly S664 (Fla. Oct. 25, 2007). The petition for discretionary review is therefore denied.

No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d).

LEWIS, C.J., and WELLS, ANSTEAD, CANTERO, and BELL, JJ., concur.
