ORDER

In the above-referenced appeal, this Court issued a memorandum order on December 21, 2023 dismissing the appeal of appellants, Elizabeth Thomas, Allan Haye, and James Andersen. However, on December 19, 2023, Thomas filed a voluntary bankruptcy petition under Chapter 13 of Title 11, United States Code, in Case No. 23-34971 in the United States Bankruptcy Court for the Southern District of Texas. "A bankruptcy suspends [an] appeal and all periods in the [Texas Rules of Appellate Procedure] from the date when the bankruptcy petition is filed until the appellate court reinstates or severs the appeal in accordance with federal law." Tex.R.App.P. 8.2. Because the Court issued its December 21, 2023 memorandum order after "the date [that Thomas's] bankruptcy petition [was] filed" in the United States Bankruptcy Court for the Southern District of Texas, the Court withdraws its December 21, 2023 memorandum order.

It is so ORDERED.
