Opinion
No. 31047.
September 29, 1961. Rehearing Denied October 17, 1961.
Writ of certiorari to the District Court of Appeal, Third District.
Henry Burnett and Fowler, White, Gillen, Humkey Trenam, Miami, for petitioner.
Joseph G. Headley and Headley Sudduth, Miami, for respondent.
The petition for writ of certiorari reflected apparent jurisdiction in this Court. We issued the writ and heard argument of the parties. After hearing argument, and upon further consideration of the matter, we have determined that the petition is without merit. Therefore the writ must be and is hereby discharged, Fla.App., 124 So.2d 36.
It is so ordered.
