Id. (quoting Coleman v. Pricewaterhousecoopers, LLC, 854 A.2d 838, 842 (Del. 2004)). In Thomas v. Capano Homes Inc., 2015 WL 1593618, the Court recently denied a Motion to Dismiss where the parties disagreed as to when the statute of limitations began to accrue. The Court held that

In short, all of these arguments by Rite Aid require specific facts not yet available and inquiries never engaged under Rule 12(b)(6).
However, under Delaware Superior Court Rule 12(b)(6), the Court will dismiss a complaint "if it appears with reasonable certainty that, under any set of facts that could be proven to support the claims asserted, the plaintiff would not be entitled to relief."Thomas v. Capano Homes Inc., 2015 WL 1593618, at *2 (Del. Super. Apr. 2, 2015). Id.
