Thomas v. a C Concrete

Supreme Court of Michigan

Opinion

No. 110491.

August 7, 1998.

Leave to Appeal Denied August 7, 1998:

Court of Appeals No. 204220.

I dissent from this Court's denial of leave and would remand to the Court of Appeals and direct that court to comply with MCR 2.002(C) and MCR 7.219(G). Plaintiff has asserted that her only income is from social security, with a state supplement. The lower court and this Court have waived the fees, and I see no reason for the Court of Appeals not to have done so as well.

KELLY, J.

I join in the statement of Justice CAVANAGH.
