Assumpsit. Plaintiff confessed judgment on two notes and instituted execution proceedings against Raceway. Before MARSH, J. The Bank intervened, execution was stayed and the judgment opened. Order entered granting Bank summary judgment. Defendant appealed. Appeal, No. 2104, Oct. T., 1978, from Court of Common Pleas of Monroe County, June T., 1977, Nos. 61 and 62. Argued March 21, 1979.
