The Vethan Law Firm, P.C. and Charles M.R. Vethan v. Eaglewood Homeowners Association, Inc.

County Civil Court at Law No. 1 of Harris County No. 1207363

ORDER

Richard Hightower, Judge

Appellants appeal from the trial court's November 7, 2023 interlocutory order denying appellants' motion to compel arbitration. Appellants have filed a motion to stay seeking a stay of trial court proceedings pending disposition of the accelerated appeal. Appellee filed a response to the motion to stay opposing it.

Rule 29.3 permits an appellate court to issue temporary orders necessary to preserve the parties' rights. See Tex. R. App. P. 29.3. Trial is currently set for January 8, 2024 and appellants' brief in this appeal is not due until January 2, 2024. Accordingly, we find that temporary orders are necessary to preserve appellants' rights.

We grant appellants' motion and stay trial court proceedings pending disposition of this accelerated appeal.

It is so ORDERED.
