Opinion
August, 1822.
The Court of Chancery continued open until Saturday, the 31st of August, when it was adjourned to Monday, April 7, 1823, at which time the Orphans' Court will also be held at New Castle. The day on which the Court of Chancery should sit, according to the Act of Assembly, 4 Del. Laws 662, 663, will be Friday, the 11th of April; but on account of the increase of business and number of causes postponed at the this term by reason of the indisposition of Messrs. Rodney and McLane, the absence of George Read with his sick daughter, Mrs. McLane, and the attention required by George Read, junior, to Mr. Hollingsworth, the husband of Mr. Read's wife's sister, THE CHANCELLOR determined to hold the Court of Chancery and the Orphans' Court, a few days earlier in April next. And so the Court of Chancery was adjourned to the 7th of April. The law does not fix on any period for the Orphans' Court. And whenever the judge of that court and the clerk attend, it may be held.
