We approve the referee's findings of fact and recommended discipline, except as set forth below.

Respondent is suspended from the practice of law for three years, effective, nunc pro tunc, October 6, 2006.

Further, respondent is directed to retake and obtain a passing score on only the ethics portion of The Florida Bar Exam prior to seeking reinstatement.

Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Victor Joseph Labruzzo in the amount of $1,425.00, for which sum let execution issue.

Not final until time expires to file motion for rehearing, and if filed, determined. The filing of a motion for rehearing shall not alter the effective date of this suspension.
