The Florida Bar v. John Francis Lakin
Not final until time expires to file motion for rehearing, and if filed, determined.
Lower Tribunal No(s).: 2024-00,194 (12B) HRE
Upon consideration of the uncontested Report of Referee and the Stipulation for Summary Proceedings, the referee's report and stipulation are approved in part, and John Francis Lakin is reinstated effective immediately under the terms and conditions set forth in the report and stipulation, except the Court disapproves the condition that Respondent must speak to new judges as part of the available training for new judges about the underlying incident which led to the disciplinary matter.
Petitioner is placed on probation for one year and must comply with the following conditions of probation. Petitioner's noncompliance with any requirement is cause for contempt and additional disciplinary measures. Petitioner must attend The Florida Bar's Ethics School, in person, where scheduled by the Bar, within six months of the date of the Supreme Court of Florida's order reinstating him to the practice of law, and shall pay the $750.00 fee associated with attending Ethics School prior to his attendance.
Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from John Francis Lakin, in the amount of $1,564.00, for which sum let execution issue. These disciplinary costs are not dischargeable in any future proceedings, including, but not limited to, a petition for bankruptcy. Respondent will be delinquent and ineligible to practice law if respondent does not satisfy the cost judgment within 30 days of this order, unless The Florida Bar Board of Governors defers payment.
