MOTION DECISION

Present - Hon. Barbara R. Kapnick, Cynthia S. Kern Anil C. Singh Saliann Scarpulla John R. Higgitt, Justice Presiding, Justices.

Appeals having been taken to this Court from separate orders of the Supreme Court, New York County, entered on or about April 08, 2022 (Case No. 2022-02599) and January 13, 2023 (Case No. 2023-00369), And defendant-appellant, pro se, having moved: (1) to stay enforcement of the aforesaid orders pending hearing and determination of the appeals taken therefrom; (2) for an extension of time in which to perfect the appeal on Case No. 2022-02599; (3) to consolidate the briefing schedule for both appeals and for this Court to use its discretion in setting said schedule, and if denied, and in the alternative, for an extension of time in which to perfect the appeal under Case No. 2022-02599 within 30 days of the date of this order; and (4) to grant defendant-appellant leave to serve papers herself, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the branch of the motion which seeks to stay enforcement of the orders pending the hearing and determination of the aforesaid appeals is denied, and

It is further ordered that the branch of the motion which seeks an extension of time in which to perfect the appeal under Case No. 2022-02599 is granted to the extent of extending the time in which to perfect the appeal to the September 2023 Term of this Court, with no further extensions to be had; sua sponte, the appeal under Case No. 2023-00369 is extended to the September 2023 Term of this Court, with no further extensions to be had, and

It is further ordered that the branch of the motion which seeks consolidation is denied as unnecessary as the appeals may be consolidated as of right (See, 22 NYCRR 1250.9[f][3]), and

It is further ordered that defendant-appellant is granted leave to serve hard copies of papers herself, provided that service is made such that it is received by the date due, using guaranteed overnight mail or similar service.
