THE COURT.

It is ordered that the opinion filed herein on October 2, 2001, 92 Cal.App.4th 819); 112 Cal.Rptr.2d 284 be modified as follows:

1. On page 22, line 3 [92 Cal.App.4th 839, advance report, 3d par., line 5] the words “exceptional circumstances, the exceptional risk, or the exceptional success” are deleted and the following is to be inserted in its place: “level of risk or any other circumstances.”

2. On page 23, second sentence of the second full paragraph [92 Cal.App.4th 841, advance report, 1st par., line 2], the words “in the ability” are deleted.
