CASE NO. 00-478-BH (S.D. Ala. Oct. 31, 2000)

Opinion

CASE NO. 00-478-BH.

October 31, 2000.

ORDER

This Court has previously entered an Order regarding settlement, which was proposed to the Court by the parties. That Order ordered the distribution of a sum certain amount of money to the parties, as agreed by the parties. However, the interpled funds were originally placed in an interest bearing account, and the Court has now realized that there is more money in the account (due to the interest earned) than the parties have agreed to distribute. The amount left over (after Court fees) is $46.82.

The court has been advised by the attorneys for both Mrs. Thames and Mrs. Goodwin that this $46.82 ought to be dispersed in the same proportion as was agreed to in the settlement agreement. That proportion is equal to 66.7% of the money being due to Mrs. Thames, and 33.3% being due to Mrs. Goodwin. Accordingly, Mrs. Thames should have distributed to her an additional $31.23, and Mrs. Goodwin should have distributed to her an additional $15.59.

The total amount of these disbursements shall be made through the parties' attorneys. Mrs. Thames' attorney is Michael Harbin (Soc. Sec. Number 422-86-9146). Mrs. Goodwin's attorney is Thomas Boller (Tax I.D. 631232517).
