Appeal, No. 40, Jan. T., 1971, from judgment of Court of Common Pleas of Montgomery County, No. 64-13019, in case of Clarence S. Thalheimer et al., ind. and as co-partners, t/a Thalheimer Weitz v. R. M. Luff Construction Company et al. Judgment affirmed.

Assumpsit. Before HONEYMAN, J., without a jury.

Finding in favor of plaintiff and against individual defendant; exceptions thereto by defendant dismissed, and judgment entered. Defendant appealed.
