MEMORANDUM OPINION
This is an accelerated appeal from an interlocutory order signed September 20, 2017, denying appellant's motion to dismiss based on a failure to comply with TEX. CIV. PRAC. & REM. CODE § 74.351(a). The parties filed an agreed motion for voluntary dismissal of the appeal, stating that they have reached an agreement and appellee executed a nonsuit of claims against appellant. Thus, the parties assert that any issues that would have been raised in this appeal are now moot. The parties also request expedited issuance of the mandate.
Accordingly, we grant the parties' motion and dismiss the appeal. See TEX. R. APP. P. 42.1(a), 43.2(f). We dismiss any pending motions as moot. The Clerk of the court is instructed to issue the mandate immediately.
