This case is scheduled for trial at the New York City, New York, Trial Session of the Court scheduled to begin on February 27, 2023. On February 1, 2023, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. Therein, respondent moves that the Court dismiss this case for failure to properly prosecute and find that there is due from petitioner a deficiency of $42,760 and $0 accuracy-related penalty under I.R.C. 6662(a) for the taxable year 2019.
