PRESENT:

Respondent-appellant having applied for permission to proceed as a poor person and for assignment of counsel on the appeals taken herein from orders of the Family Court, Erie County, entered in the Office of the Clerk of said Court on May 16, 2016, and May 17, 2016,

Now, upon reading and filing the certification of Jessica N. Mussell, Esq., dated May 20, 2016, and due deliberation having been had thereon,

It is hereby ORDERED that the appeal from the order entered May 16, 2016, is dismissed on the ground that no appeal lies from an order entered upon consent (see Matter of Cherilyn P., 192 AD2d 1084, lv denied 82 NY2d 652), and

It is further ORDERED that the appeal from the order entered May 17, 2016, is dismissed on the ground that the order appealed from is not an order of disposition appealable as of right (see Family Court Act § 1112 [a]), and

It is further ORDERED that the application is dismissed.
