MEMORANDUM OPINION


On November 27, 2006, the parties filed an agreed motion requesting that we set aside the trial court's judgment and remand the case to the trial court. Accordingly, the Court GRANTS the motion. We VACATE the trial court's judgment without regard to the merits and REMAND the case to the trial court for further proceedings. Tex. R. App. P. 42.1(a)(2) 43.2(d).
