Opinion

Case No. 4D02-3559.

Opinion filed March 26, 2003.

Appeal from the Circuit Court for the Fifteenth Judicial Circuit, Palm Beach County; Marvin Mounts, Jr., Judge; L.T. Case No. 97-4498 CFA02.

Sandra L. Tennell, Quincy, pro se.

Charles J. Crist, Jr., Attorney General, Tallahassee, and Donna M. Hoffmann, Assistant Attorney General, West Palm Beach, for appellee.

Sandra Tennell appeals the trial court's order resentencing her to 109.75 months imprisonment without her presence at the required resentencing hearing. Given the State's concession of error, we reverse the order below and remand with instructions for the trial court to conduct a resentencing hearing at which Appellant shall be present.

POLEN, C.J., FARMER and GROSS, JJ., concur.
