DAVID MARK TEMPLE, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 178th District Court Harris County, Texas Trial Court Cause No. 1008763

Panel Consists of Justices Zimmerer, Jewell, and Hassan.

ABATEMENT ORDER

PER CURIAM.

On May 30, 2024, the parties filed a joint motion to abate this appeal or alternatively order the record supplemented because the reporter's record is missing the records of hearings held on October 1, 2018 and February 5, 2020. We grant the motion in full.

We direct the court reporter of the 178th District Court to file a supplemental reporter's record by July 15, 2024 containing records of the trial court's hearings conducted on October 1, 2018 and February 5, 2020. See Tex.R.App.P. 34.6(d).

The appeal is abated, treated as a closed case, and removed from this court's active docket. The appeal will be reinstated on this court's active docket when the supplemental reporter's record is fully filed in this court. The court will also consider an appropriate motion to reinstate the appeal filed by either party, or the court may reinstate the appeal on its own motion.
