On March 22, 2023, the Commissioner filed a Motion for Leave to File an Amendment to Answer and lodged the Amendment to Answer. On April 7, 2023, Mr. Tempelman filed a Motion to Dismiss on the Ground of Mootness. Thereafter, on April 27, 2023, the Commissioner filed a Motion for Extension of Time Within Which to File a Response to Petitioner's Motion to Dismiss on Ground of Mootness, as supplemented, and a Motion for Continuance.

Upon due consideration of the parties' motions and for cause, it is

ORDERED that the above-referenced motions are set for hearing at the calendar call of the Court's May 22, 2023, standalone remote trial session beginning 1:00 P.M. (Eastern Time). The parties may refer to the Notice of Remote Proceeding, served March 22, 2023, for additional details. It is further

ORDERED that, on the Court's own motion, the cases at Docket No. 10889-22L and Docket No. 12039-22L are hereby consolidated for trial, briefing, and opinion.
