ORDER
Pending before the Court is Appellant's motion to permit the El Paso Public Defender's Office to re-brief the case. Appellant's brief was filed on November 22, 2013 and the State's brief was filed on February 27, 2014. Thus, the case has been at issue since February 27, 2014 and it is ready to be set for submission to the Court. However, the trial court entered an order appointing the El Paso County Public Defender's Office to represent Appellant on March 17, 2014 and this Court granted Appellant's motion to substitute counsel.
Appellant's request to permit his case to be re-briefed at this late date threatens to interfere with the orderly administration of the Court's docket and the fair administration of justice. At the same time, the Court is mindful of the need to ensure that Appellant's right to the effective assistance of counsel on appeal is preserved. The motion is GRANTED but only to the extent that Appellant's counsel will be permitted to file an amended brief. See TEX.R.APP.P. 38.7. Appellant is permitted to raise new issues in his amended brief. Appellant's amended brief is due to be filed no later than August 23, 2014 and the State's brief filed in response is due to be filed no later than 45 days after Appellant's amended brief is filed. The parties are advised that the Court will not look favorably on any extension requests absent extraordinary and compelling circumstances.
