    The cases cited by Sun Life in support of its position are unpersuasive. In TECO Coal Corp. v. Looney, Case No. 1:08CV00024, 2008 U.S. Dist. LEXIS 95826 (W.D. Va. Nov. 25, 2008), the court found that TECO Coal Corporation was a fiduciary under the plan because it was listed as a fiduciary in a document entitled "ERISA Information and Statement of ERISA Rights." Id. at *7 n. 3. Although the document explicitly was not part of the "benefits booklet," the court still considered it as evidence of the terms of the plan.
