May 15, 2001
784 So. 2d 577 (Fla. Dist. Ct. App. 2001)

Opinion

No. 1D01-194.

Opinion filed May 15, 2001.

An appeal from an order of the Circuit Court for Duval County. Mallory D. Cooper, Judge.

Dismissed.

A. James Mulaney, III, Jacksonville, for appellant.

No appearance for appellee.

The notice of appeal was not timely filed in this proceeding and accordingly the appeal must be dismissed for lack of jurisdiction. That dismissal, however, is without prejudice to appellant's right to petition the circuit court for relief. In the Interest of E.H., 609 So.2d 1289 (Fla. 1992).

DAVIS, PADOVANO and BROWNING, JJ., Concur.
