Case No. 2:01-CV-0724TC

May 20, 2003

ORDER

Plaintiff Shirley Taylor has requested that the court allow a jury trial and decision against Defendant American Land and Leisure, Inc. ("ALL") and take the part of the jury's verdict concerning Defendant the United States of America (the "United States") as advisory. The United States does not oppose Ms. Taylor's request. For the reasons set forth in Ms. Taylor's memorandum in support of a jury trial, the court will hold a jury trial in this case. The jury, however, will be advisory as regards the United States's liability.

An eight-day trial in this case is scheduled to begin on October 20, 2003. In the event that the trial does not begin in October, a first place trial setting has been scheduled for June 28, 2004.

The October trial date is a second place trial setting.

IT IS SO ORDERED.
