DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Rockland County, dated December 10, 2021. Motion by the respondent Hillside Mikvah to enlarge the record to include certain material, or in the alternative, to strike stated portions of the appellant's brief, and to extend the time to serve and file a brief. Motion by the respondent Town of Ramapo Zoning Board of Appeals to extend the time to serve and file a brief. Separate motion by the respondent Hillside Mikvah to dismiss the appeal as academic.

Upon the papers filed in support of the motion by the respondent Hillside Mikvah, inter alia, to enlarge the record and the papers filed in opposition and in relation thereto, and upon the papers filed in support of the motion by the respondent Town of Ramapo Zoning Board of Appeals and the papers filed in opposition thereto, and upon the papers filed in support of the motion by the respondent Hillside Mikvah to dismiss the appeal and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion by the respondent Hillside Mikvah which is to enlarge the record to include certain material is granted to the extent that on or before November 6, 2023, the appellant shall serve and file a supplemental record containing the papers filed in support of and in opposition to Hillside Mikvah's motion to dismiss the complaint via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the supplemental record and upload a digital copy of the supplemental record, with proof of service thereof, through the digital portal on this Court's website; and it is further, ORDERED that the branch of the motion by Hillside Mikvah which is to strike stated portions of the appellant's brief is denied; and it is further, ORDERED that the branch of the motion by Hillside Mikvah which is to extend the time to serve and file a brief is denied as academic, as it has filed its brief; and it is further, ORDERED that the motion by the respondent Town of Ramapo Zoning Board of Appeals which is to extend the time to serve and file a brief is denied as academic, as it has filed its brief; and it is further, ORDERED that the motion by the respondent Hillside Mikvah to dismiss the appeal as academic is denied.
