Opinion

Case No. 97-1281

August 27, 1997

Appeal of order denying rule 3.800(a) motion from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Barry E. Goldstein, Judge; L.T. Case Nos. 93-21842 CF, 93-20528 CF.

Victoria Taylor, Monicello, pro se.

Robert A. Butterworth, Attorney General, Tallahassee, and Aubin Wade Robinson, Assistant Attorney General, West Palm Beach, for appellee.

We treat the notice of appeal as a petition for writ of habeas corpus to permit belated appeal. Having granted the petition, we affirm the trial court's order denying appellant's motion to correct an illegal sentence.

GLICKSTEIN, DELL and KLEIN, JJ., concur.
