Before the Court is appellant's second Motion to Supplement the Record on Appeal and to Hold the Briefing Schedule in Abeyance. Appellant again requests supplementation of the clerk's record to include the bill of costs following the January 24, 2024 Judgment Adjudicating Guilt. That judgment states, "Court Costs: $286.00." We observe that there is a bill of costs dated September 28, 2022, on page 87 of the clerk's record showing total costs of $386.00 plus a fine of $2,500. That bill of costs shows $2,500 had been paid leaving the remaining amount due, $386.00. However, that bill of costs from 2022 does not explain the January 24, 2024 judgment's statement that there are court costs of $286.00.

On June 28, 2024, this Court granted Appellant's June 26, 2024, motion to supplement the record with the bill of costs from the adjudication. This Court ordered the Dallas County District Clerk to file a supplemental clerk's record containing the bill of costs in support of the January 24, 2024, judgment. On July 22, 2024, the Dallas County District Clerk filed a supplemental clerk's record in this cause. The supplemental clerk's record contains the following three documents: this Court's June 28, 2024 Order, this Court's June 28, 2024 letter regarding the Order, and a nunc pro tunc amending the judgment "to read that court costs be $386." The supplemental clerk's record, however, does not include a bill of costs in support of the $286 in court costs assessed originally in the January 24, 2024 judgment. Nor does the supplemental record include a bill of costs in support of the trial court's July 12, 2024 nunc pro tunc increasing the amount of court costs to $386.

Accordingly, we GRANT appellant's second Motion to Supplement the Record on Appeal and to Hold the Briefing Schedule in Abeyance. We ORDER the Dallas County District Clerk to file on or before SEPTEMBER 5, 2024 a supplemental clerk's record containing the bill of costs in support of the January 24, 2024 judgment and in support of the trial court's July 12, 2024 nunc pro tunc increasing the amount of court costs to $386. Appellant's brief will be due THIRTY DAYS after the supplemental clerk's record containing the bill of costs is filed with this Court.

We DIRECT the Clerk to send copies of this order to the Honorable Dominique Collins, Presiding Judge, Criminal District Court No. 4, Dallas County; Felicia Pitre, Dallas County District Clerk; and counsel for all parties.
