SHUNDALE TAYLOR, Appellant v. THE STATE OF TEXAS, Appellee
On Appeal from the 204th Judicial District Court Dallas County, Texas
Trial Court Cause No. F16-75497-Q
ORDER
Before the Court is court reporter Trashuna Salaam's August 25, 2017 second request to extend time to file the reporter's record. We GRANT the request and ORDER the reporter's record filed by September 8, 2017.
On August 10, 2017, the Clerk rejected the district clerk's filing of a supplemental clerk's record in this case because no clerk's record has yet been filed. On August 15, 2017, the district clerk responded with a letter addressed to the Clerk representing that the clerk's record the district clerk attempted to file on August 10, 2017 was properly designated as a supplemental clerk's record because the district clerk had filed a clerk's record in this case on October 10, 2016.
Notice of appeal in this case was filed on May 30, 2017. The district clerk, therefore, has not filed a clerk's record in this appeal. However, on October 10, 2016, the district clerk did file a clerk's record in cause no. 05-16-01106-CR, styled Ex parte Shundale Taylor, that involved an appeal from the trial court's denial of appellant's application for writ of habeas corpus seeking a reduction of appellant's pretrial bail.
We DIRECT the Clerk to transfer the clerk's record filed with the Clerk on October 10, 2016 from cause no. 05-16-01106-CR, styled Ex parte Shundale Taylor, into the record of cause no. 05-17-00658-CR styled Shundale Taylor v. The State of Texas. We further DIRECT the Clerk to file a copy of this order in cause no. 05-16-01106-CR.
We ORDER the Dallas County District Clerk to file the clerk's record in this appeal within FOURTEEN DAYS of the date of this order.
We DIRECT the Clerk to transmit a copy of this order, by electronic transmission, to court reporter Trashuna Salaam, the Dallas County District Clerk, and to counsel for the parties.
