Appeal, No. 263, Jan. T., 1937, from judgment of Superior Court, Oct. T., 1936, No. 281, affirming judgment of C. P. No. 3, Phila. Co., Dec. T., 1934, No. 9451, in case of C. Burgess Taylor v. City of Philadelphia. Judgment affirmed.

Assumpsit. Before BOK, J., specially presiding.

The facts are stated in the opinion of the Superior Court, reported in 126 Pa. Super. 196.

Verdict and judgment for plaintiff. Defendant appealed to Superior Court which affirmed the judgment. Appeal by defendant to Supreme Court allowed.

Errors assigned, among others, were action of Superior Court in overruling defendant's various assignments of error.

Samuel Feldman, Assistant City Solicitor, with him Joseph Sharfsin, City Solicitor, for appellant.

Clarence G. Myers, with him Duane, Morris Heckscher, for appellee.

John P. Connelly, with him Leon I. Mesirov, for Registration Commission, amicus curiæ.


The judgment is affirmed on the opinion of the able President Judge of the Superior Court.

We do not consider that the question of the constitutionality of The Personal Registration Act of July 10, 1919, P. L. 857, 25 PS Sec. 341, is involved in this appeal.
