ORDER

Pending before the Court is Appellees' Joint Motion to Dismiss Appeal and Objection to Order for Mediation Referral. On February 27, 2014, the Court issued an order for mediation referral which requires the parties to make any objection to the referral within ten days. Appellees timely filed their objection to mediation referral on March 10, 2014. Accordingly, the Court orders the appeal to continue and lifts the suspension of the appellate timetable. The record is now due to be filed on or before April 17, 2014.

The Court has determined it will not take any action on Appellees' motion to dismiss the appeal until Appellant has been provided with an opportunity to file a response. That response is due to be filed no later than March 24, 2014.

IT IS SO ORDERED this 12th day of March, 2014.
