McClendon, J., dissents. Parties may obtain discovery regarding any matter, not privileged, which is relevant to the subject matter involved in the pending action. La. Code Civ. P. art. 1422. Plaintiff's claims pursuant to La. R.S. 22:1973 remain pending at this time, and accordingly, plaintiff is entitled to obtain discovery on such pending claims.
