Order reversed, with ten dollars costs and disbursements, and motion denied, with ten dollars costs, upon condition that the plaintiff, within ten days after service of a copy of this decision, make and file with the clerk of Monroe county the stipulation recited in the order appealed from. Otherwise order affirmed, with ten dollars costs and disbursements. All concurred.
