This case is scheduled for trial at the New York City, New York, Trial Session of the Court scheduled to begin on February 27, 2023. On February 1, 2023, respondent filed a Motion to Dismiss for Failure to Properly Prosecute in which respondent requests that the Court dismiss this case for failure to properly prosecute and find that there is due from petitioner a deficiency of $9,530 and $597 accuracy-related penalty under I.R.C. 6662(a) for the taxable year 2018. For cause, it is

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute is set for hearing at the calendar call of this case at 10:00 a.m. (ET), Monday, February 27, 2023, at the Jacob K. Javits Federal Building, 26 Federal Plaza, Courtroom 206, New York, New York, 10278.

Petitioner is advised that failure to appear at the scheduled hearing may result in the granting of respondent's motion.
