JUDGMENT ORDER


AND NOW, this ____ day of May 2004, upon consideration of the parties' cross-motions for summary judgment, it is hereby ORDERED that:

1. Defendant's Motion for Summary Judgment is GRANTED;

2. Plaintiff's Partial Motion for Summary Judgment is DENIED;

3. Judgment is entered in favor of defendant, and against plaintiff;

4. Any pending motions are DENIED AS MOOT.
