    While the award of legal fees is not intended to address a party's decision to proceed to trial rather than agree to a settlement (see, O'Shea, supra; Comstock v.Comstock, 2003 N.Y. Slip Op. 17997 [Nov. 3, 2003]), the relative merits of the parties' positions and actions during this litigation have been especially important and should be considered, as well. See, Walker v.
