MOTION DECISION

PRESENT: WHALEN, P.J., SMITH, PERADOTTO, LINDLEY, AND CURRAN, JJ.

Petitioner-respondent having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Allegany County, entered August 16, 2022, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is hereby ORDERED that the motion is denied, and

Upon the Court's own motion, It is further ORDERED that the order of this Court entered January 25, 2023, which granted respondent-appellant permission to proceed as a poor person and assignment of counsel, is hereby vacated, with leave to renew appellant's request for that relief upon the submission of a formal motion, which includes, among other things, an affidavit that sets forth appellant's gross monthly income from all sources, assets with their value, and financial obligations, and addresses the allegations and information set forth in petitioner-respondent's affidavit, sworn to February 6, 2023, and attachments, as to appellant's assets, including real estate holdings and bank accounts.
