The notice of deficiency upon which this case is based was issued to Edna Tasker, Deceased. The petition and First Amended Petition were filed by Cynthia Rospert. Ms. Rospert failed to attach to the petition or the First Amended Petition letters testamentary or letters of administration. On November 9, 2022, respondent filed a status report, to which he attached an Entry Relieving Estate from Administration from the Probate Court of Erie County, Ohio, indicating that Ms. Parlee is the commissioner for the Estate of Edna M. Tasker.

Upon due consideration, it is

ORDERED that, on or before March 6, 2023, respondent shall file a status report with the Court concerning the then-present status of this case, including respondent's position as to whether, under Ohio law, Cynthia Rospert has the capacity to represent decedent before this Court.
