Norman Tarver v. Irene Ibarra and Robert Ibarra

Trial court: 335th District Court of Bastrop County, Trial court case number: 29,295

ORDER

Richard Hightower, Judge

Appellant's original brief was struck for failure to comply with the requirements of Rule 38.1. The Court ordered an amended brief filed by October 23, 2023. A corrected brief was filed on October 23, 2023, but it failed to comply with our order. On December 5, 2023, the Court issued another order striking the brief filed on October 23, 2023 and ordered appellant to file a corrected brief by December 15, 2023. On January 5, 2023, appellant filed a motion for extension of time to file the corrected brief. Appellant asked for an extension until January 30, 2024 to file the corrected brief.

The motion is granted in part and denied in part. The Court grants an extension but denies the request for an extension until January 30, 2024. The Court grants an extension until January 16, 2024, which is 30 days from the date the brief was due. No further extensions will be granted, and if the brief is not filed by January 16, 2024, the Court may dismiss the appeal without further notice. If the corrected brief is filed but does not comply with the order of December 5, 2023, the Court may dismiss the appeal without further notice.

It is so ORDERED.
