Tarver v. Fidelity Mutual Insurance Company

Court of Appeal of Louisiana, First Circuit
Mar 20, 1956
86 So. 2d 235 (La. Ct. App. 1956)

Opinion

No. 4159.

March 20, 1956.

Appeal from District Court, Parish of East Baton Rouge; G. Caldwell Herget, Judge.

Watson, Blanche, Fridge, Wilson, Posner Thibaut, Baton Rouge, for appellant.

Huckabay, Seale, Kelton Hayes, Baton Rouge, for appellees.

This is a companion suit to LaFuria v. Tarver, reported at 86 So.2d 232. Since for the reasons more fully set forth therein we found that the present plaintiff's negligence was a contributory proximate cause of her accident with defendants' vehicle, the judgment of the District Court dismissing plaintiff's demand of $102.07 is affirmed at appellant's cost.

Affirmed.
