Dec 10, 1991
589 So. 2d 1040 (Fla. Dist. Ct. App. 1991)

Opinion

Nos. 90-2210, 90-2714.

December 10, 1991.

An Appeal from the Circuit Court of Dade County, Thomas M. Carney, Judge.

Alan Jay Braverman, Fort Lauderdale, for appellant Tardif.

Sonnett Sale Kuehne and Benedict P. Kuehne, Miami, for appellant Miller.

Robert A. Butterworth, Atty. Gen. and Monique T. Befeler, Asst. Atty. Gen., for appellee.

Before BARKDULL, GERSTEN and GODERICH, JJ.

We reverse based on the authorities of Amado v. State, 585 So.2d 282 (Fla. 1991) and Essex v. State, 539 So.2d 559 (Fla. 4th DCA 1989).

We find that the remaining points raised by the defendants lack merit.

Accordingly, we reverse and remand for a new trial.
