ORDER


For the reasons set forth in Magistrate Judge Ellis' report and recommendation, dated December 17, 2001, to which no objection has been filed, defendants' motion to dismiss the complaint is granted to the extent that the action is dismissed as against the New York State Department of Civil Service and denied in all other respects.

SO ORDERED.
