An appeal and a cross appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about September 15, 2022, and the cross appeal (now denominated the appeal) having been perfected by defendant-appellant, And defendant-appellant having moved to compel plaintiff-respondent to pay her share of the costs of the joint record on appeal, or, in the alternative, to dismiss her cross appeal and to permit a supplemental application for the costs and fees of submitting the instant motion, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the branch of the motion seeking dismissal of plaintiff's cross appeal is denied as moot (see 22 NYCRR 1250.10[a]); the motion is otherwise denied.
