No. 05-05-01615-CV (Tex. App. Jul. 28, 2006)

Opinion

No. 05-05-01615-CV

Opinion Filed July 28, 2006.

On Appeal from the 116th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 02-2573-F.

Dismiss.

Before Chief Justice THOMAS and Justices LANG and MAZZANT.

MEMORANDUM OPINION

The Court has before it appellees CitiCapital Commercial Corporation, Robert J. Reagan, William McLain, and Juanita Edgecomb's June 28, 2006 motion to dismiss the appeal. In their motion, appellees assert, in part, that appellant failed to file a brief on the June 9, 2006 due date and has not since filed a brief or a motion for extension. Appellees therefore request an involuntary dismissal. Appellant did not respond to the motion to dismiss

Our record reveals that appellant's brief was due June 9, 2006. We sent appellant a letter, dated June 29, 2006, directing appellant to file a brief or risk dismissal of her appeal. Appellant has not filed a brief or otherwise communicated with the Court.

We therefore GRANT appellees' motion and DISMISS the appeal for want of prosecution. See Tex.R.App.P. 42.3(b).
